PIP reform · 8 July 2026

The PIP reform is coming. Your B2B contracts may not survive.

Starting 8 July 2026, the Polish Labour Inspectorate can reclassify your B2B agreement into a full employment contract — retroactively, including taxes and social charges. Here is the survival kit, written by our in-house lawyers.

What is changing on 8 July 2026

Until now, only a court could reclassify a B2B contract into employment. After 8 July, PIP inspectors can do it administratively — issuing decisions that take effect immediately. The employer (or your client, if you are a freelancer) becomes liable for back-taxes, ZUS contributions, holiday pay and labour-law penalties going back up to 3 years. The reform was passed in 2025 and the implementation period is now closing.

Who is at risk

You are at risk if you work for a single client for >50% of your time, use their tools, sit at their office, follow their schedule, and have no other clients on your invoice book. Most "B2B contractors" working in Polish IT, design, and marketing firms fit at least 3 of these criteria. After 8 July, every one of those contracts becomes a ticking PIP-clock.

How BIZ UP solves this

BIZ UP sits between you and your client as the contracting party. You sign a cooperation agreement with us — a Polish sp. z o.o. with a different ownership, different address, different operational reality. PIP cannot reclassify your relationship with your end-client because, legally, you have no direct contract with them. We carry the contractor risk on a portfolio of 1,500+ freelancers, and our in-house lawyers maintain contract templates audited quarterly.

What you should do this week

1. Download our PIP-readiness checklist (link below). 2. Audit every active B2B contract against the 12 criteria. 3. For any contract that scores ≥7/12, move it onto the BIZ UP umbrella — usually completed within 5 business days. 4. Order our PIP-Audit service (199 zł) for borderline cases where you want a written legal opinion.

PIP reform — frequently asked

  • Will PIP audit every B2B contract automatically?

No, but they will respond to complaints and run sector audits. IT, marketing, design, and content companies are the obvious first targets given that sole-trader B2B is the dominant model there.

  • What is the back-tax exposure?

Up to 3 years of ZUS contributions, PIT, holiday pay, and severance. For a typical 12 000 zł/month B2B contract, the exposure is roughly 200 000–280 000 zł per worker. The liability falls primarily on the hiring company, but contractor can be sued for joint liability under article 415 of the Civil Code.

  • Does BIZ UP "hide" the relationship from PIP?

No. We are fully transparent — BIZ UP is a registered Polish company filing taxes monthly. What we do is restructure the legal relationship so that PIP would have to litigate against us (a multi-customer payroll provider with 1500+ contractors), not against the end-client. This is exactly how umbrella companies in the UK survived IR35.

  • Can I keep my JDG and use BIZ UP only for the risky client?

Yes. Many of our SCALE/BIZRUPTOR clients run a parallel JDG for safe clients and route the high-risk relationships through us. The 30%-residence-permit discount is one reason. The PIP-shield is another.
